SERVING YORBA LINDA
Estate planning in Yorba Linda
Yorba Linda is mostly single-family homes, many on larger lots in the hills north of the Santa Ana River, and many owners have stayed in the same house for decades. Over that time, the home often becomes the largest part of the estate. Many Yorba Linda clients come to me with a trust drafted years ago, sometimes in another county or state, or with no plan at all, and the first step is finding out what still works.
YORBA LINDA HOMES
What Yorba Linda homeowners ask about trusts
Is there a transfer tax on the trust deed?
No. Orange County charges documentary transfer tax on sales at $0.55 for each $500 of value, but it exempts a transfer into a trust for the benefit of the same owner. The exemption is stated on the trust deed itself. Read the difference between a grant deed and a deed of trust.
What gets filed after a death?
When a Yorba Linda home is held in a trust, the trustee files a Change in Ownership Statement (BOE-502-D) in Orange County within 150 days after the death (Rev. & Tax. Code § 480). If the home instead goes through probate, the personal representative files it no later than the inventory. Read clearing title after a spouse dies.
Leaving the home to your children
A child who inherits your home keeps your assessed value only if the child makes it their principal residence, and only up to your assessed value plus $1,044,586 for transfers from February 16, 2025 through February 15, 2027 (Proposition 19). A child who will not live there inherits it at a new assessed value, so the trust can give your trustee room to sell.
If you become ill
A funded trust lets your successor trustee pay bills, manage your home, and deal with your bank without a court-ordered conservatorship. Your durable power of attorney covers anything outside the trust, and your healthcare directive names who speaks with your doctors. Read about powers of attorney.
PROBATE IN ORANGE COUNTY
Probate on a Yorba Linda home
A Yorba Linda home that passes by will or without a plan generally goes through probate in the Superior Court of California, County of Orange. The statutory fees are calculated on the gross value of the estate, not the equity (Prob. Code §§ 10800, 10810). On a $1.3 million home, the attorney and personal representative fees total $52,000 before court costs. A living trust holding the home avoids them. I do not handle probate cases; I refer probate matters to other counsel. Read how probate works in California and what probate costs.
FREQUENTLY ASKED QUESTIONS
Common questions
Our trust is from the 1990s. Does it still work?
It may, but older trusts often require a split into separate trusts after the first death, which can cost the survivor flexibility and the second step-up in basis. Federal estate tax law has changed a great deal since then, and a review shows whether yours needs an update.
Should I name one child or all of them as trustee?
One child, with a backup, is usually easier. Co-trustees generally must act together, which slows down every decision and signature. Choose the child best able to handle the work, not necessarily the oldest.
I already have a trust. Can you review it?
Yes. Many trusts were drafted before a move, a marriage, a new child, or a change in the law. A review tells you whether yours still works.
