1. Protecting Your Most Precious Assets: Minor Children

In California, if you don't nominate a guardian in a legal document, a judge—who doesn't know your family—will decide who raises your children. A proper estate plan allows you to:

In California, estates valued over $184,500 (or real estate valued over $69,625) often must go through probate—a public, slow, and expensive court process.

Example: A typical family home in Redondo Beach (90277 or 90278) currently has a median value of $1,500,000 to $2,700,000.

If a $1.5M home goes through probate, the statutory legal and executor fees alone could exceed $56,000. A Living Trust allows your home to pass to your heirs immediately, privately, and without those court-mandated fees.

3. Maximizing Tax Benefits: The "Double Step-Up"

California is a community property state, which offers a massive tax advantage for married couples. If you bought your Redondo Beach home years ago for $800,000 and it’s now worth $2M, a "Double Step-Up in Basis" allows the entire property's tax basis to jump to $2M when the first spouse passes away. This can potentially save your family hundreds of thousands of dollars in capital gains taxes if the property is ever sold.

4. 401(k) Transfers & Designated Beneficiaries

Your retirement accounts (like a 401k or IRA) are "non-probate" assets, but only if your Designated Beneficiaries are up to date.

  • Spousal Protection: Under current rules, a surviving spouse can usually "roll over" a 401(k) into their own IRA, deferring taxes and continuing growth.

  • The Catch: If you name your estate instead of a person (or a trust), the account may be forced into probate and liquidated quickly, creating a massive tax bill for your heirs.

The "Living" Part of Your Plan: Incapacity

Estate planning isn't just about what happens when you pass; it's about what happens if you're injured or ill. Without an Advance Healthcare Directive and Durable Power of Attorney, your spouse may have to petition a court for "conservatorship" just to pay your mortgage or make medical decisions.
